Peru: What is the Personal Data Protection policy?

The personal data protection policy in Peru is governed by the currentPersonal Data Protection Law – Law 29733– and aims to guarantee the fundamental right of people to the protection of their privacy. For which purpose, it requires that the processing of your personal data be proportional and secure, in accordance with purposes consented to by such persons or authorized by law, thus preventing such data from being trafficked and/or used illicitly.

At UR Global, as experts familiar with the current regulations in Peru, we are in charge of preparing both the Disclaimer and the Personal Data Protection policy for companies in Peru.

Importance of developing the Personal Data Protection policy

The Personal Data Protection policy in Peru establishes obligations on companies to ensure adequate processing of the personal data of their clients, suppliers, workers and other people linked to their activity. Likewise, this legislation and its regulations recognize the rights of the people to whom said data belong.

The main obligations to comply with the Protection of Personal Data will therefore be: Register with the Authority the Personal Data Banks (BDP) that they possess and obtain informed consent from the owners of the personal data.

According to the definition of the Law, a Personal Data Bank is any organized set of information on natural persons. This information may be stored in automated media (such as documents in Word, Excel, PDF and even in images, audio or audiovisuals, recorded on the company’s computers or servers, electronic platforms, files in the cloud, etc.); or, in non-automated media (such as physical files and filing cabinets, printed billing documents, worker files, etc.).
