How Does Remote or Hybrid Work Operate Within a Company?

During the state of health emergency due to COVID-19, various measures were implemented, which were regulated and maintained once the state of emergency passed. In accordance with the provisions of Law 1221 of 2008, Article 7, the TELEWORKER REGISTRY. "Every employer who hires teleworkers must report this relationship to the Labor Inspectors of the respective municipality, and where there are no such inspectors, to the Municipal Mayor. For this purpose, the Ministry of Protection must regulate the form to provide the necessary information."

If the telework model, including the associated organizational requirements, is not properly implemented within the company, it will not be possible for employees to remain in a hybrid or fully teleworking model.

In practice, this law is summarized in several points that we at UR Global are working on to ensure companies comply with: Legal documents: Compliance with current legislation by preparing legal documents (teleworking agreement, amendment to the internal work regulations to include a chapter regulating this issue, work disconnection policy), and more.
  • Teleworking contract template
  • Agreement modifying current contracts to teleworking mode
  • Annexed chapter to the work regulations
  • Work disconnection policy
  • Registration of contracts with the Ministry of Labor
Additional obligations: The employee’s salary must reflect the additional fee for connection assistance, which is intended to cover the cost of energy, internet, and/or telephone services, unless the company decides to provide it directly. At the same time, the company must provide and guarantee the maintenance of employees’ equipment, programs, energy, and other costs necessary to perform their duties. The amount must be defined internally, but by jurisprudence, it cannot be less than the transportation assistance, which is $162,000 COP.

The risks of not implementing teleworking within the company relate to several aspects: first, the issue of workplace accidents and illnesses that can be acquired. This is why the Occupational Risk Administrator (ARL) holds the company responsible for any related issues; and second, the risk of worker complaints to the ministry, which could lead to an inspection that could lead to financial penalties of up to $6,500,000,000 COP.
